New Delhi: Advocate Vikas Pahwa, counsel for BMW accident accused Gaganpreet Kaur, has challenged the Delhi Police’s account of the fatal crash near Dhaula Kuan, claiming that the official FIR contradicts statements made by the DCP in a press conference. The FIR, registered 10 hours after the incident, reportedly differs from police remarks regarding the sequence and location of the accident. According to Pahwa, the DCP described the car hitting the victims at a sharp turn, suggesting the vehicle’s front crashed first, causing a two-wheeler to strike a DTC bus.

"We read the FIR, which was registered 10 hours after the incident. The incident happened at 1.30 pm and an FIR was filed at 11.30 pm...The information in the FIR contradicts the press conference of the DCP... It seems incorrect," Pahwa told ANI.

Pahwa further argued that the accused, her husband, and children were inside the vehicle when its airbags deployed, resulting in their injuries as well, making this, in his view, a case not of rash and negligent driving, but one that raises doubts over applying section 304 (culpable homicide not amounting to murder). He claims the police escalated the charges unnecessarily, turning a bailable offence into a non-bailable one by adding sections that do not suit the facts.

The advocate also alleged procedural lapses, stating that crucial CCTV footage was not presented in court, and that after the crash, the accused made efforts to take the victims to a hospital, even calling ahead to alert doctors for emergency preparation. Medical evidence reportedly shows the victims arrived at the hospital within 46 minutes, but Navjot Singh, a Ministry of Finance employee, was declared dead around 2:16 am; his wife remains hospitalised with multiple injuries.

Meanwhile, the accused was remanded to two days’ judicial custody after her arrest, with a bail application now pending and scheduled for hearing the day after tomorrow. Advocate Ishan Dewan, representing the deceased, confirmed that police had sought judicial custody and stressed the need to ensure accountability so such incidents are not repeated. Both legal teams have signalled their intent to present all facts for judicial review.
