Thiruvananthapuram: Police officials are in internal discussions over whether a case can be registered against MLA Rahul Mamkootathil, who faces allegations of sexual  misconduct towards women. The deliberation is based on audio messages and chat screenshots that have emerged so far. The key issue under consideration is whether a case can be sustained in the absence of a formal complaint.

Legal advice is also likely to be sought, sources indicate.

While allegations against Rahul have surfaced on social media and news channels, no direct complaint has been received by the police to date. An audio clip allegedly suggesting that he pressured a woman to undergo an abortion has also been circulated. However, without a formal complaint, police are unable to proceed with a case, even though inciting someone to undergo an abortion is a criminal offence that can carry up to 10 years in prison.

Some complaints have reportedly been submitted by third parties, but these are not considered sufficient grounds for legal action.

The government’s current stance is to close cases where the alleged victims, even after testifying before the Hema Committee, express no interest in pursuing legal action. The decision on whether to proceed with a case against Rahul Mamkootathil will similarly depend on whether any complainants come forward and on subsequent government direction.
