New Delhi: The Supreme Court on Friday declined to hear a writ petition filed by Prashant Kishor’s Jan Suraaj Party (JSP) challenging the results of the Bihar Assembly Elections 2025. The party had sought directions to the Election Commission of India (ECI) to declare the election results “null and void” and conduct fresh polls.

A bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi dismissed the petition as withdrawn after granting liberty to the petitioner to approach the appropriate High Court. During the hearing, the Chief Justice questioned the party’s electoral performance, reportedly asking, “How many votes your party got? If people reject, then you approach the judicial forum to get popularity.”

The Jan Suraaj Party had alleged that fresh beneficiaries were added under the Mukhyamantri Mahila Rojgar Yojana and payments of Rs 10,000 were made during the subsistence of the Model Code of Conduct. The petition argued that these actions violated constitutional provisions, including Articles 14, 21, 112, 202 and 324.

The scheme provides an initial grant of Rs 10,000 to women to start small businesses and promote self-employment. JSP also sought action under Article 324 of the Constitution and Section 123 of the Representation of the People Act, alleging corrupt practices linked to the alleged direct benefit transfers to 25–35 lakh women voters. The petition further challenged the deployment of 1.8 lakh women beneficiaries from Jeevika groups at polling booths.

The BJP-led National Democratic Alliance retained power in Bihar, securing 202 out of 243 seats. The INDIA bloc won 35 seats, including six for the Congress. The Jan Suraaj Party failed to win any seat, with most of its candidates forfeiting their deposits.

The matter may now be pursued before the relevant High Court if the party chooses to do so.
