Prashant Kishor’s Jan Suraaj Party approaches SC, challenging Bihar 2025 elections and seeking fresh polls over alleged Model Code violations.

New Delhi: Former election strategist Prashant Kishor’s Jan Suraaj Party (JSP) has approached the Supreme Court challenging the Bihar Assembly elections held in 2025 and is seeking fresh polls in the state. The case is expected to be heard on Friday, February 6, 2026, before a Bench of Chief Justice of India Surya Kant and Justice Joymalya Bagchi.
The BJP-led NDA retained power in Bihar, winning 202 out of 243 seats, while the INDIA bloc managed only 35, including six for Congress. The Jan Suraaj Party failed to secure any seat, with most of its candidates losing their deposits.
In its plea, the JSP alleged that the Bihar government violated the Model Code of Conduct by transferring ₹10,000 each to women beneficiaries under the Mukhyamantri Mahila Rojgar Yojana after the poll schedule was announced. The party argued that such transfers unfairly influenced voters.
The petition requested the Election Commission to act under Article 324 of the Constitution, which governs the superintendence, direction, and control of elections, and Section 123 of the Representation of People Act, which deals with corrupt practices. According to the JSP, the cash transfers disrupted a level playing field during the Assembly polls.
The scheme provides women with an initial grant to start small businesses, aimed at promoting self-employment and women’s empowerment. However, the party claimed that executing the transfers after the election schedule had been announced amounted to electoral malpractice.
The Supreme Court will consider the petition and decide whether fresh elections are warranted in the state.
