Malappuram: Some legal experts have pointed out that it will not be easy to cancel the license even if the driver is caught talking on Bluetooth device while driving. The police had informed the other day that driving license can be cancelled if the driver is caught talking via Bluetooth. However, the experts said this will not be possible due to legal issues.

The dangerous driving defined in the Motor Vehicle Act section 184 as 'using mobile phone with hands'. However, this was changed to 'communication devices used with hands' in the amendment made in 2019. Also more points were added in the definition of dangerous driving.

However, the punishment for all this are imprisonment and fine only. Earlier, the fine was Rs 1000 and it was increased to Rs 10,000. Six months jail term also is part of the punishment. The police also admit that the Motor Vehicle Act need to be amended in order to cancel the license for this offence.

Currently, states do not have the authority to amend the act. Even if the license is cancelled, the case is likely to be dismissed by the court. So, there are confusions about how to implement the police direction.

Enforcement RTO T G Gokulnath said that using phone while driving will affect concentration and this can lead to accidents. People have to be more attentive while talking on phone rather than speaking to a person sitting near. So, it is better to avoid using phone in any way while driving vehicles, he added.
