Kochi: The Kerala High Court has mandated stringent conditions, including a bank guarantee, for the release of vehicles seized for dumping waste in public places. Justice Bechu Kurian Thomas, who issued the directive, observed that releasing such vehicles under lenient conditions could encourage repeat offences.

The case concerns MA Suhail, a resident of Thrissur, who sought the release of his vehicle seized by the Kunnamkulam police for dumping toilet waste into a water body. Suhail’s petition had previously been dismissed by the Kunnamkulam First Class Magistrate Court, prompting him to appeal the decision.

Despite stringent measures by local authorities, illegal waste dumping remains a persistent issue. The High Court emphasised the need for tougher measures to tackle this ongoing problem.

The court has now ordered that the vehicle be released only upon the provision of a bank guarantee of Rs 2 lakh. Suhail must also furnish a personal bond of Rs 1 lakh, along with two sureties of equal amounts. Additionally, he is required to submit an affidavit to the Magistrate's Court, pledging that the vehicle will be produced on demand and will not be used for any illegal activities.

Furthermore, the court's order prohibits the movement, rental, or sale of the vehicle until the trial concludes. It also warns that should the offence recur, the police may seize the vehicle again.
