
New Delhi: The Kerala Government has requested the Supreme Court to issue warrants against the accused who were acquitted by the High Court in the case where CPM leader P Jayarajan was attacked. The state government alleged that the accused are attempting to delay the proceedings in the case, which is currently under the consideration of the Supreme Court. In response to an appeal filed by P Jayarajan against the acquittal of the accused, the Supreme Court issued a notice to respondents. The Supreme Court bench, consisting of Justices Sudhanshu Dhulia and Vinod Chandran, decided to hear detailed arguments on the matter on March 3.
In the case where an attempt was made to murder P Jayarajan by attacking him at his home, the trial court had convicted six RSS activists, but the High Court acquitted all except one. The sentence of the second accused, Chirukandoth Prashanth, was also reduced by the High Court. Both the state government and P Jayarajan approached the Supreme Court against this decision.
Earlier, the Supreme Court had issued a notice to the respondents in response to the state government’s appeal. Senior advocates N Nagamuthu, appearing for the state government, and Standing Counsel C K Sasi requested that warrants be issued to the accused as per Section 390 of the Criminal Procedure Code, since the appeal is pending. The advocates representing the state government pointed out in the Supreme Court that the accused have not responded to the notice issued in the appeal, which they believe is an attempt to delay the proceedings.
The attempt on P Jayarajan’s life occurred on August 25, 1999, on Thiruvonam day, when nine RSS activists attacked him at his house in Eastern Kadirur. The trial court convicted six of them in 2007, while three were acquitted. However, the High Court found only the second accused, Chirukandoth Prashanth, guilty in the case.
The accused, including Kunniyil Shanub, Thaikandi Mohanan, Para Sasi, Jayaprakan, Kanicheri Aji, Elanthottu Manoj and Koyyon Manu were acquitted by the High Court. Senior advocates P V Dinesh and P S Sudheer represented P Jayarajan, while senior advocates Siddharth Luther and A Sirajuddin appeared for the accused
