Kochi: The Kerala High Court has ordered the Director General of Education to ensure compliance with the guidelines issued by the state government regarding the implementation of the Right to Education (RTE) Act. The ruling came when a division bench comprising chief justice S Manikumar and Justice Murali Purushothaman was considering the petition filed by Thrissur native TN Mukundan.
The petitioner alleged that the unaided schools in Kerala are not following the mandate under the RTE Act.
According to section 12(1) of the RTE, private unaided schools should provide at least 25 percent of seats to the children from socially and economically weaker sections, who reside in the locality.
The Act prohibits the conduct of interviews or examinations for admissions to Class I, which is also being violated in several unaided schools here. The act advocates making classrooms inclusive of students from all sections and communities.
The school authorities have to give admission by conducting a draw of lots from the applications submitted under the reservation category. Interviews or examinations should not be carried out for the admissions to the remaining 75 per cent of seats too.
