A Consumer Dispute Redressal Commission in Malappuram has held that insurance companies cannot reject the claim of a vehicle owner for not having a driving licence.
The ruling came in the backdrop of a petition moved by Eliyamma, an Amarambalam native, against Future Generali India Life Insurance.
The petitioner's husband, Kurian, died in a car accident in December 2015. The car belonging to him met with the accident. However, the car was driven by his grandson. He had taken an insurance policy that gave coverage to the vehicle owner. However, the insurance company rejected their claim. The company argued that the vehicle owner lacked a driving licence.
Following this, Eliyamma filed a complaint with the Consumer Dispute Redressal Commission. The commission remarked that the policy provides insurance coverage to the vehicle owner and his family. Therefore, the commission directed the insurance company to pay the claim.
The court pointed out that a person does not need a driving licence to own a vehicle. Therefore, it is baseless to demand a licence to issue insurance.
