New Delhi: In the BMW accident case near Dhaula Kuan that killed Ministry of Finance Deputy Secretary Navjot Singh, the accused Gaganpreet Kaur has moved a bail application, insisting the incident was “wholly accidental” and without intent. Her counsel pointed out that she is a mother of two young daughters, has no prior criminal record, and also suffered a head injury during the crash.

The bail plea, filed under Section 480 of the Bharatiya Nagarik Suraksha Sanhita, 2023, argues that custodial interrogation is unnecessary since Kaur has cooperated with the investigation, poses no flight risk, and is unlikely to tamper with evidence. On Monday, Duty Judicial Magistrate Akanksha Singh remanded her to two days of judicial custody after she was produced by Delhi Police at the judge’s residence. The court has issued notice on her bail application, fixing the hearing for September 17, and has also directed jail authorities to ensure she receives medical care.

Senior Advocate Vikas Pahwa, assisted by Advocate Prabhav Ralli, opposed the police’s remand plea, flagging a 10-hour delay in FIR registration. Advocate Ishan Dewan appeared for the victim’s side. Police have charged Kaur under sections dealing with culpable homicide not amounting to murder, among others.

According to the prosecution, Kaur’s BMW hit a divider and overturned, triggering a chain of events where the victim’s motorcycle collided with a DTC bus. Both Kaur’s family members and the motorcyclists were injured and hospitalised before her arrest on September 15. She remains in judicial custody until her bail plea is decided on September 17.
