Court orders investigation after rejecting the police report. FIR alleges Tini Tom called Ansiba Hassan a 'jihadi', made sexually coloured remarks and spread the claims among AMMA members

Kochi: Details of the first information report (FIR) registered on actor Ansiba Hassan's complaint against actor Tini Tom have emerged, alleging that he attempted to portray her as a "jihadi" and a religious extremist and made obscene and sexually coloured remarks against her.
The FIR was registered after a court directed the police to investigate the case, rejecting a report by the Kadavanthra Police that had concluded Tini Tom's remark referring to Ansiba as a "jihadi" was made in jest.
Alleged incident during AMMA rehearsal
According to the FIR, the alleged incident took place on February 13 during a rehearsal for the AMMA family gathering at the Regional Sports Centre in Kadavanthra.
The FIR states that Tini Tom spoke to Ansiba in an obscene manner and used sexually coloured language. It further alleges that he referred to her as a "jihadi" and a religious extremist.
The complaint also claims that he spread these allegations among other members of the Association of Malayalam Movie Artists (AMMA), portraying Ansiba in the same manner.
According to the FIR, the alleged remarks hurt Ansiba's religious identity, damaged her reputation and caused her mental distress.
Court orders case
A court recently directed the police to register a case against Tini Tom based on Ansiba's complaint. He has been booked under provisions related to insulting the modesty of a woman and making communal insults.
Responding on Wednesday, the Kochi City police commissioner said the issues that had surfaced were internal matters within AMMA and maintained that there had been no lapse in the police investigation.
Neena Kurup's statement cited
The statement of actor and former AMMA executive committee member Neena Kurup was cited as a key factor before the court.
According to her statement to the police, Tini Tom made insulting remarks about Ansiba at the AMMA office. Neena Kurup also stated that actor Shwetha Menon had told her about the same incident.
Earlier police report found no grounds for a case
Ansiba had earlier lodged a complaint with the police alleging that Tini Tom had personally insulted her by calling her a "jihadi" and accusing her of religious conversion.
As part of a preliminary inquiry, the police recorded statements from both Ansiba and Tini Tom before submitting a report to the assistant commissioner of police stating that no case could be registered.
The Kadavanthra Police report said Ansiba's complaint was based on hearsay and that there was insufficient evidence to initiate legal proceedings on the allegations.
Court rejects police findings
The court, however, held that there was a prima facie case against Tini Tom.
It observed that the petitioner's arguments had merit. The court also noted that the police report stated the alleged offence had not occurred within the jurisdiction of the Kadavanthra Police Station.
If that was the case, the court said, the police should have registered an FIR and transferred it to the police station with the appropriate jurisdiction.
Following the court's direction, the police registered a case against Tini Tom.
