Kochi: Thaha Fasal has surrendered before the NIA court here in the Pantheerankavu UAPA case. Kerala High Court on Monday had cancelled the bail granted to Thaha Fasal in the Pantheerankavu UAPA case. The court had ordered Thaha to surrender immediately.

The action was taken based on the appeal filed by NIA demanding the cancellation of bail granted to both Alan and Thaha. NIA argued that the accused were granted bail without taking into account the evidence against them. The division bench including Justices A. Hariprasad and K. Harilal considered the Central government’s argument that the trial court examined the evidence but did not give it the required importance.

The trial court only had to examine if sections 38 and 39 of UAPA were valid in the case. Although the personal freedom of the youth is important, it is inferior to the nation’s interest. Some of the evidence collected have elements of separatism. UAPA aims to prevent such activities. If the evidence and statements of witnesses are considered, the court cannot agree to the bail.

Meanwhile, the court did not want to cancel Alan Shuhaib’s bail. Alan’s age and medical treatment was also taken into account by the court. Evidence collected from Alan is less serious. Considering these factors, the court approved the bail granted to Alan.

The Pantheerankavu police arrested Thaha and Allan in November 2019, due to alleged Maoist links. The court then granted them bail subject to strict conditions, on September 9.
