Kochi: The Ernakulam District Consumer Disputes Redressal Commission has issued a key directive to multiplexes in Kerala, stating that if outside food and beverages are not permitted inside cinema halls, the theatres must ensure free availability of purified drinking water to all customers.

The directive was part of a recent verdict on a consumer complaint filed by a Kozhikode native against PVR Cinemas in Kochi. The complaint alleged that the multiplex prohibits outside food and beverages while simultaneously charging exorbitant prices for food and drinks sold inside the premises, a practice the complainant described as an unethical business model.

In response, PVR Cinemas defended its policy, stating that the restriction on external food items is a standard and reasonable safety measure applicable to all visitors. The company argued that the policy is essential for maintaining hygiene, cleanliness, and ensuring that prohibited or hazardous substances such as intoxicants or inflammables, are not brought into the cinema halls under the guise of food.

PVR further clarified that it does not compel customers to purchase food and also provides purified drinking water free of charge within its premises. The cinema operator stated this formally before the court.

The bench, headed by DB Binu, and members V Ramachandran and TN Srividya, noted that despite being given adequate time, the complainant failed to provide substantial evidence or an affidavit to support the allegations. The court pointed out that under the Consumer Protection Act, the burden of proof lies with the consumer, and in this case, the complaint was dismissed due to insufficient evidence.

However, the court referred to a previous Supreme Court ruling which upheld the right of cinema theatre owners to restrict outside food. While dismissing the complaint, the court instructed PVR Cinemas to maintain clean and hygienic facilities for providing free drinking water and to install clear signboards informing customers about the availability of this service.
