New Delhi: A petition filed on Tuesday has sought action against Congress leader Sonia Gandhi, alleging that her name appeared on the electoral rolls three years before she became an Indian citizen.

The application, submitted before Additional Chief Judicial Magistrate Vaibhav Chaurasia under Section 175(4) (which empowers a magistrate to order an investigation), requests that the police be directed to investigate the allegation that Gandhi became an Indian citizen in 1983, yet her name was listed in the 1980 electoral roll.

Senior advocate Pavan Narang, representing the complainant Vikas Tripathi, argued that documents indicate Sonia Gandhi acquired Indian citizenship on April 30, 1983.

He stated that her name was included as a voter in the New Delhi constituency in 1980, removed in 1982, and re-entered in 1983 after she obtained Indian citizenship.

"The reason for the deletion is nowhere recorded. There can only be two possible explanations — either the individual takes citizenship of another country or submits a Form 8 (application for correction in particulars) — but either way, the person must already be a citizen," Narang said.

He questioned, "What documents were submitted to the Election Commission when her name was included in 1980?"

He alleged that there had been "some forgery" and that a public authority had been "deceived."

"My limited request is that the police be directed to register an FIR under the relevant sections. Whether or not the charges are substantiated is for the police to determine," Narang submitted.

He also suggested that, in the interim, a notice could be issued to the police to submit a status report.

The court has scheduled the matter for hearing on September 10.

Earlier in August, BJP IT cell chief Amit Malviya made similar through a detailed post on X, calling her inclusion in the voter roll “institutionalised theft” and a “clear violation of the law”.
