During the proceedings, the court orally indicated that invoking Article 226 of the Constitution was not the appropriate legal remedy for challenging the remand order.

New Delhi: Cockroach Janta Party (CJP) co-conveners Saurav Das and Ashutosh Ranka on Wednesday withdrew their petition from the Delhi High Court challenging a Special Executive Magistrate's (SEM) decision to extend their judicial custody in connection with a protest at Jantar Mantar.
Justice Subramonium Prasad, who heard the matter during the court's Dussehra break, advised the petitioners to await the outcome of proceedings scheduled before the SEM later in the day. The court also said they could approach the appropriate appellate forum if their grievances remained unresolved.
Allowing the petition to be withdrawn, the judge clarified that no observations had been made on the merits of the case.
During the proceedings, the court orally indicated that invoking Article 226 of the Constitution was not the appropriate legal remedy for challenging the remand order.
The matter reached the High Court after Das and Ranka sought an urgent hearing against the SEM's October 19 order extending their judicial custody by two days.
The two CJP leaders were initially detained on October 13 after allegedly scaling a locked gate to enter Jantar Mantar, which had earlier been denotified as a designated protest venue.
They were subsequently placed under preventive arrest and remanded to five days in judicial custody.
On Monday, a newly appointed Special Executive Magistrate at Mandir Marg police station ordered their continued judicial detention until October 21 after they were produced before him.
Das and Ranka were among several CJP workers who entered Jantar Mantar carrying the national flag and raised slogans against Chief Election Commissioner Gyanesh Kumar.
Police detained the protesters and initiated preventive action following the demonstration on October 13.
The withdrawal of the High Court petition comes as the two leaders await further proceedings before the Special Executive Magistrate concerning their custody.
