The Trump administration has warned ineligible voters of prosecution as the Justice Department launches its largest-ever election-monitoring operation across all 50 states.

A warning of prosecution from the Department of Homeland Security and an unprecedented deployment of election observers by the Justice Department have put election security under the spotlight as Americans head to the polls for the 2026 US midterm elections.
The Trump administration has issued a stern message to individuals it considers ineligible to vote, warning that those who attempt to cast ballots illegally could face prosecution.
At the same time, the Justice Department has announced an extensive nationwide monitoring exercise, deploying more than 1,000 monitors and observers across all 50 states.
Markwayne Mullin, Secretary of the US Department of Homeland Security (DHS), took to X to warn people against voting if they do not meet the eligibility requirements.
Stressing that only American citizens should vote, Mullin said federal authorities would pursue those who violate voting laws.
‘If you vote illegally in this country, and you are NOT eligible to vote, @DHSgov will find you, hunt you down, and you will be prosecuted to the fullest extent of the law. Only American citizens should be deciding American elections,’ he wrote.
The warning comes alongside a major election-monitoring initiative the Justice Department announced.
Assistant Attorney General Harmeet K Dhillon, who heads the department's Civil Rights Division, confirmed that more than 1,000 monitors and observers would be deployed on Election Day to oversee voting-related processes.
‘Happy Election Day! @CivilRights is sending 1,000+ monitors & observers to all 50 states to help ensure a free & fair election. Every American’s vote should count,’ Dhillon wrote in a post on X.
She also encouraged voters to flag any irregularities or difficulties to their local election officials or directly to the Justice Department.
The department described the deployment as its largest election-monitoring operation. It also marks the first time the DOJ has sent observers to all 50 states.
The Civil Rights Division is coordinating the nationwide exercise, with personnel drawn from different divisions of the Justice Department, US Attorneys’ Offices, and federal observers from the Office of Personnel Management.
Together, the DHS warning and the DOJ's extensive observer deployment have placed voter eligibility and election oversight at the centre of the national conversation as the United States votes in the 2026 midterms.
