London: Former Astronomer CEO Andy Byron is reportedly considering legal action against Coldplay, following a viral moment at one of the band’s recent concerts that has drawn widespread media attention and led to his resignation.
According to a report by Page Six, Byron may pursue a defamation claim after footage from a Coldplay concert showed him sharing an intimate moment with the company's head of human resources, Kristin Cabot, on the venue’s kiss cam.
The moment, which quickly went viral on social media, captured the pair during a light-hearted segment of the show. Coldplay frontman Chris Martin, in a brief on-stage comment, remarked: “Either they’re having an affair or they’re just very shy.”
The off-the-cuff remark sparked speculation and public scrutiny of Byron and Cabot’s personal lives. In the days following the incident, both Byron and Cabot resigned from their positions at Astronomer, amid growing backlash and an internal investigation by the company’s board of directors.
Speaking to Page Six, attorney Camron Dowlatshahi commented on the potential for a defamation case, suggesting that Byron could argue Martin’s comment falsely implied the existence of an affair.
“If we are getting creative, a possible claim would be for defamation, specifically as it relates to Chris Martin characterising the two as having an ‘affair’,” Dowlatshahi said.
However, the legal expert noted that such a claim would face significant challenges. Byron would need to prove the statement was false, defamatory, and made with actual malice--in other words, that Chris Martin knowingly made a false statement or acted with reckless disregard for the truth.
“None of those elements will be met, so any claim against Coldplay would be frivolous,” Dowlatshahi added. “I also very much doubt that Mr Byron would want further public scrutiny by bringing a borderline frivolous suit against the event organisers and/or Coldplay.”
As of now, Coldplay has not publicly commented on the matter.
