Kochi: The Kerala High Court on Tuesday directed a State-wide ban on the use and sale of single-use plastics, with effect from October 2. The Special Bench of Justice Bechu Kurian Thomas and Justice P. Gopinath, which is overseeing waste management in the State, passed the order to protect the public's fundamental right to a clean and safe environment.
Where the ban will apply
The court’s directions cover all hilly tourist destinations in Kerala with high footfall. Items banned include plastic food containers, plastic plates, plastic cups, plastic straws, plastic sachets, and plastic bakery boxes. However, the use of 5-litre plastic water bottles and 2-litre plastic soft drink bottles is exempted from the ban.
The Court ordered that plastic water bottles under 5 litres, soft drink bottles under 2 litres, plastic straws, plates, cups, and cutlery are banned in all official functions held by Central and State governments within the State.
A similar restriction will apply to weddings, auditoriums, restaurants, and hotels. The High Court mandated that the use of these items must be prohibited as a licensing condition for such venues and businesses.
Water kiosks and sustainable alternatives suggested
The Bench instructed authorities to install sufficient water kiosks in hilly tourist spots to provide clean drinking water. It recommended offering water in glass bottles or through kiosks as an alternative to plastic. Tourists are to be discouraged from carrying single-use plastic and instead urged to bring reusable water bottles.
Prevention and awareness measures mandated
The Court asked the State and Local Self Government bodies to prevent dumping of plastic waste into rivers, canals, and backwaters. It also directed the State to raise public awareness on the harmful effects of single-use plastics and improper waste disposal.
