New Delhi, Nov 5 (PTI) The Supreme Court on Thursday sought responses from the Centre and others on a petition which flagged the issue of accessibility for persons with disabilities in residential buildings.
The plea came up for hearing before a bench of Justices Vikram Nath and Aparesh Kumar Singh.
"This PIL (public interest litigation) relates to accessibility norms in buildings for persons with disabilities," the counsel appearing for the petitioner said.
The plea has referred to the provisions of the Rights of Persons with Disabilities Act, 2016, including the one which deals with mandatory observance of accessibility norms.
The counsel argued that the 2016 Act was clear that no establishment can get a completion certificate unless it conforms to accessibility norms.
After the bench said it was issuing notice to the Centre and others on the plea, the counsel referred to a pending petition of 2005 which has sought directions to ensure meaningful access to public spaces for persons with disabilities.
The counsel requested the top court that the plea be tagged with the pending petition.
The bench agreed to the request and tagged the matter with the pending plea. It posted the matter for hearing after four weeks.
Besides other prayers, the plea has sought a direction that no completion certificate or occupancy certificate be granted to a building unless it complies with the accessibility requirements.
The apex court had in November 2024 delivered a judgment on the plea filed in 2005.
It had directed the Centre to implement mandatory accessibility standards within three months.
It had noted that in December 2017, the apex court had delivered a judgment in the matter and identified 11 action points pursuant to the Act and the Accessible India Campaign for compliance.
The bench had said these action points pertained to the accessibility of a range of infrastructure, including government buildings, railways, airports and transport carriers.
