New Delhi: The Central Drugs Standard Control Organisation (CDSCO) has issued a public notice clarifying that injectable preparations do not come under the definition of cosmetics under the Drugs and Cosmetics Act, 1940, and warned against the misuse of cosmetic products for treatment purposes.
The move comes amid the rising popularity of injectable cosmetic procedures at beauty and aesthetic clinics, where products are often promoted for skin brightening, anti-ageing treatments and facial enhancement.
In the notice issued by the Directorate General of Health Services under the Union Health Ministry, the CDSCO stated that cosmetics are only meant to be “rubbed, poured, sprinkled or sprayed” on the human body for cleansing, beautifying, promoting attractiveness or altering appearance.
“Products supplied in form of injectable preparation do not fall under the definition of cosmetics. No cosmetic is permitted to be used as injection by consumer/professionals/aesthetic clinics,” the notice said.
The regulator further stressed that cosmetics are not permitted to be used for treatment by professionals or individuals and warned manufacturers and sellers against making false or misleading claims about cosmetic products.
The CDSCO also cautioned against the use of prohibited ingredients in cosmetic products and said that misuse of cosmetics through injections would attract violations under the Drugs and Cosmetics Act and Rules.
“As per the provisions of labelling, no cosmetic may purport or claim to purport or convey any idea which is false or misleading to the intending user of cosmetics,” the notice added.
The agency urged consumers, professionals, importers and manufacturers to report any such violations or suspicious practices to the regulatory authorities through the CDSCO website or state licensing authorities.
