One year after the death of actor Malcolm-Jamal Warner, a legal dispute over the late actor's estate has brought his family into the spotlight. His widow, Tenisha Warner, has filed a lawsuit against his mother, Pamela Warner, seeking more than $1.2 million (£940,000) over what she says are unpaid financial obligations outlined in their prenuptial agreement and issues surrounding his family trust. 

The lawsuit, filed in DeKalb County Superior Court in Georgia on the first anniversary of Warner's death, names Pamela Warner in her capacity as the successor trustee of the Warner Family Trust. While the case centres on contractual obligations rather than allegations of wrongdoing related to his death, it has raised questions about how the actor's estate was structured and why the dispute has now reached court.

What is the lawsuit about?

According to court filings, Tenisha Warner claims her late husband agreed to provide several financial benefits before and during their marriage but did not fulfil those commitments before his death.

The largest claim involves a $1 million term life insurance policy that, under the couple's prenuptial agreement, was meant to name Tenisha as the beneficiary. The lawsuit alleges that the policy was never obtained or maintained.

In addition, she claims Warner had agreed to make annual tax-free payments of $16,000 on each wedding anniversary, contribute the maximum allowable amount each year to a Roth Individual Retirement Account in her name and pay her a monthly salary of $5,000 for serving as his chief of staff during their marriage.

Combined with interest and legal costs, the lawsuit states that the amount owed exceeds $1.27 million.

Why is Malcolm-Jamal Warner's mother being sued?

According to TMZ, Pamela Warner is not accused of personally failing to meet those financial obligations. Instead, she is being sued because she now serves as the trustee of the Warner Family Trust following her son's death.

As trustee, she is responsible for overseeing the trust and distributing its assets according to its terms. Tenisha Warner is asking the court to enforce the provisions of the prenuptial agreement and recover the money she believes is owed from the estate.

Court documents also argue that the trust currently in place was created in 1996, decades before Malcolm-Jamal Warner met Tenisha and long before the couple had their daughter.

According to the filing, the trust names other family members as beneficiaries and does not account for his wife or daughter, prompting Tenisha to ask the court to recognise both of them as omitted spouse and omitted heir under applicable law.

Why did Tenisha Warner take legal action now?

In a statement released through her attorney, Tenisha Warner said she had spent the past year trying to resolve matters privately before deciding to file the lawsuit.

She explained that legal action became necessary before any potential limitation period expired.

"I attempted to privately settle my beloved husband’s complicated estate and honor his last wishes," she said in a statement.

Tenisha added that Warner had intended to update his estate planning before his death.

"Malcolm had every intention to provide for our nine-year-old daughter and me."

She also said he had been preparing to replace an estate plan drafted in 1996 when he was 26 years old, years before their relationship began.

"Sadly, he was unable to do so before we lost him. I have been struggling to care for our daughter as a single mom and now as her sole provider."

She concluded by explaining her decision to pursue the case.

"Legally, I had no choice but to take action to protect our rights before any potential statute of limitations expired."

The background to Warner's estate

Malcolm-Jamal Warner married Tenisha on May 23, 2022, after the couple signed a prenuptial agreement several days earlier.

The actor was known for keeping his family life private and rarely spoke publicly about his wife or daughter.

He died on July 20, 2025, at the age of 54 after accidentally drowning while on holiday in Costa Rica.

Best known for portraying Theo Huxtable on ‘The Cosby Show’, Warner later built a career spanning television, directing, music and podcasting.

Following his death, Tenisha publicly honoured him on social media and announced plans to launch a company in his memory with their daughter.

Pamela Warner's public tribute

The lawsuit became public shortly after Pamela Warner marked the first anniversary of her son's death with an emotional message on social media.

Reflecting on the previous year, she wrote about grief, healing and difficult personal experiences.

"How can I be here and my child is not," she wrote.

She also urged followers to value their relationships, writing that people should "clear up any beef you may have with your loved ones, if possible. Cleanse your spirt of negativity."

Another part of her message appeared to reference the emotional challenges she had faced over the past year.

"During my year-long journey, I have discovered how cruel, evil, and greedy a human can be. I have also discovered the depth of love, care, concern and support that humans are capable of."

She did not directly mention the lawsuit.

The lawsuit asks the court to award more than $1.27 million, together with interest, legal fees and other costs. It also seeks recognition of Tenisha Warner's rights under the prenuptial agreement and requests that the court address issues relating to the family trust.
