Chandrabose murder case: SC sets aside final hearing to next month, will consider Nisham's bail plea

New Delhi: The Supreme Court on Monday postponed the final hearing of an appeal by the Kerala Government, which is seeking a death sentence for the accused in the 2015 K Chandrabose murder case, to September. The bench, comprising Justices A.S. Bopanna and M.M. Sundresh, also granted permission to consider the bail petition of the accused, Muhammed Nisham, during the upcoming final hearing.
Senior Advocate Mukul Rohatgi, who appeared for Nisham, argued that it was just a vehicle accident and questioned the decision of the prosecution to impose murder charges. However, the Supreme Court countered that it was not merely a car accident, but an extremely frightening accident case.
Mukul Rohatgi also requested bail for Nisham, asserting his client had been imprisoned for the last nine years. He further stated that Nisham was only granted parole once, for a month. Following this, the court agreed to hear his bail plea during the final hearing next month.
Meanwhile, a petition moved by Nisham challenging the Kerala High Court's decision to sentence him to life imprisonment is before Supreme Court.
Nisham assaulted Chandrabose (51) and later rammed his luxury vehicle against him in the wee hours on January 29, 2015. He was irked over the delay by the guard to open the main gate of a posh residential complex 'Shobha city' in Thrissur.
The severely injured guard died on 16 February. The case had evoked widespread protests across the state.
