Mark relaxation in Kerala SET exam not violation of Right To Equality: SC while dismissing NSS plea

New Delhi: The Supreme Court dismissed the plea challenging mark relaxation to the reserved categories in the State Eligibility Test conducted by the LBS Centre of the Kerala Government.

Nair Service Society, in 2015, challenged mark relaxation in the eligibility test for higher secondary teachers stating it is against the Right to Equality of Indian Constitution.

Court said that the NSS can approach the appropriate state government bodies against the relaxation if it has any complaints. General category students need 50 per cent mark to qualify the test while reserved category students require 45 per cent.

The bench headed by Justice Abdul Nazeer  observed that though the state has 100 per cent literacy, the same cannot be said in terms of higher education. SC also said that Kerala is a state where the beedi-making labourers read newspapers while working. It said newspapers, including Mathrubhumi, played a huge role in achieving the complete literacy.
