Allahabad HC orders FIR against Rahul Gandhi in dual citizenship case

The Lucknow Bench of the Allahabad High Court has directed the registration of a criminal case against Leader of the Opposition Rahul Gandhi. On Friday, the court ordered the Kotwali police station in Rae Bareli to file a First Information Report (FIR) to investigate long-standing allegations that the Congress MP holds British citizenship.
The order follows a petition by S Vignesh Shishir, a BJP worker from Karnataka, who challenged a January 28 ruling by a special MP/MLA court.
The lower court had previously refused to register an FIR, citing a lack of jurisdiction over citizenship matters. Overturning that decision, the High Court ruled that the serious nature of the claims—involving the Bharatiya Nyaya Sanhita (BNS), Official Secrets Act and Passport Act—requires a formal legal case.
The petitioner claims to possess confidential UK government documents and emails proving Gandhi’s British nationality. Following the order, the Uttar Pradesh government indicated it may request the transfer of the case to the Central Bureau of Investigation (CBI) for a deeper probe into potential national security implications.
