Shuhaib Murder: Supreme Court rejects plea seeking CBI investigation

New Delhi: The Supreme Court has rejected the plea seeking a CBI investigation in connection with the murder of youth congress leader SP Shuhaib of Mattannur, Kannur. On Tuesday, the court rejected the plea moved by CP Muhammad and SP Raziya, parents of Shuhaib.
While dismissing the petition of Shuhaib’s parents, the court stated that the parents have the right to seek legal recourse if someone else’s role is proven during the trial. The SC bench, consisting of BR Gawai and KV Vishwanathan, pointed out that five years have passed since the incident occurred. They also mentioned that the final investigation report has already been filed before the court.
In this situation, the court will not intervene in the demand for a CBI investigation, the court said. The parents of Shuhaib moved to court against the Kerala High Court Division Bench’s verdict canceling the Single Bench verdict that ordered a CBI investigation.
Senior advocates V Giri and MR Ramesh Babu, who appeared for Shuhaib’s parents, pointed out that the Kerala police did not conduct a proper investigation regarding the close connections of some of the accused in the case with some senior leaders of the CPM. They also argued that those who had hatched the conspiracy for the murder have not been included in the list of accused. While considering this argument, the SC stated that if someone else’s role is proven during the trial, the parents will have the right to seek legal recourse.
Senior advocate Jaydeep Gupta and Standing Counsel CK Sasi have appeared for the Kerala government. They stated that the reason behind the delay in the start of the trial of the case, for which the charge sheet was filed, was that the case was under the consideration of the Supreme Court.
