In the wake of the tragic accident in Alappuzha that claimed the lives of six medical students, the issue of illegal taxi services has once again come to the forefront. The vehicle involved in the accident was a private car hired for rent, as revealed by the investigation.

This has raised numerous concerns regarding the use of private vehicles. Can one use a relative’s or close friend’s private vehicle? Is it illegal? Transport Commissioner Ch. Nagaraju speaks with a Mathrubhumi representative on the matter.

Is there anything wrong with using a friend's vehicle?

There is no issue with borrowing a car in emergency situations. However, vehicles with eight or more seats should not be used in this manner. While small cars are sometimes borrowed, using private vehicles regularly in this way is illegal. Emergency situations are not always present, after all. Private vehicles are registered for use by their owners and their family members. Any misuse of them is illegal. Handing over a vehicle for a reward is a criminal offence.

Will insurance coverage be voided?

If an accident occurs and the owner is not in the vehicle, the insurance company may refuse to provide compensation. It will be necessary to prove that the journey was undertaken for the owner's purposes. Insurance companies have strict criteria in place to prevent the misuse of private vehicles.

Will the permit be revoked if private vehicles are used as illegal taxis?

Allowing a private vehicle to be used by someone else for a fee is a violation of permit conditions. Such violations can be easily detected, and the fine is Rs 6,000. Cases are filed for permit and fitness violations. If the offence is repeated, the fine amount will be doubled. The registration will be cancelled for six months. If the vehicle is found on the road during this period, its registration will be revoked, and it will be impounded.

Will the checks cause difficulties for ordinary people?

The checks aimed at curbing illegal taxis are not intended to target ordinary citizens. There are individuals who rent private vehicles illegally. The Motor Vehicles Department will not prevent borrowing a vehicle from a friend or relative in an emergency. No fine will be imposed for this. There is no need for concern about this.

How legally valid is the 'rent-a-car' business?

The 'rent-a-car' business is legal in the state. There are numerous licensed establishments operating in this sector. If one needs a vehicle, it can be rented from these licensed agencies.

Vehicles rented from authorised establishments are insured. These vehicles can be used legally, similar to taxi services. Certified rental vehicles are identified by a yellow number plate on a black background.
