Court orders confiscation of land belonging to Kerala DGP over sale agreement violation

Thiruvananthapuram: The Thiruvananthapuram sub-court has ordered the confiscation of 10.8 cents of land owned by the state's police chief, Darvesh Sahib, and his wife due to violations of the sale agreement. The court's decision follows a dispute involving the sale of the land to a resident of Vazhuthacaud for Rs 74 lakh.
Initially, an agreement was reached where Rs 30 lakh was paid in advance for the 10.8 cents of land. However, following inspections, it was revealed that the property was already mortgaged to a bank for a liability of Rs 26 lakh, information that was not disclosed to the buyer. This led the buyer to approach the court, seeking justice.
In response, DGP Darvesh Sahib defended the transaction, stating it was conducted transparently with a proper agreement. He explained that after receiving the advance payment, construction began on the property, but the remaining payment was not made as agreed upon. The dispute escalated when the buyer requested a refund of the advance payment due to the undisclosed mortgage.
The contract, signed on June 22, 2023, came under scrutiny only after the initial payment was made. Umar Sharif, the complainant, notified DGP Sahib of his withdrawal from the contract upon discovering the mortgage. According to him, a complaint was also filed with the Chief Minister. He said that the case would be withdrawn if the advance payment was refunded.
