'Unilateral poll panel orders’: PIL in Supreme Court seeks criminal prosecution of CEC Gyanesh Kumar

New Delhi: A Public Interest Litigation (PIL) has been moved before the Supreme Court seeking criminal prosecution of Chief Election Commissioner (CEC) Gyanesh Kumar over alleged violations of statutory duties during the Special Intensive Revision (SIR) of electoral rolls.

The petition, filed by advocate Shailendra Mani Tripathi through advocate Chand Qureshi, relies on recent media reports highlighting internal friction within the poll body. It alleges that key decisions, administrative directives, and software updates related to the voting process were executed by the CEC without obtaining the necessary concurrence of the two other Election Commissioners.

The plea requests the apex court to declare all guidelines, decisions and system modifications undertaken without majority consensus as unconstitutional and legally void. It further asserts that the CEC does not enjoy absolute immunity from prosecution when acting outside statutory mandates, urging the court to direct relevant authorities to initiate appropriate legal action.
