Justice Yashwant Varma controversy: Protests surge as Rajya Sabha debates judicial accountability

New Delhi: The controversy surrounding Justice Yashwant Varma has intensified, with protests erupting over his transfer to the Allahabad High Court following the discovery of a large sum of cash at his residence. The Allahabad High Court Bar Association has strongly opposed the Supreme Court Collegium’s decision, launching an indefinite strike and demanding a full investigation before any administrative action is taken. Lawyers argue that transferring a judge under scrutiny undermines judicial accountability and could hinder a transparent inquiry.
The protests have gained momentum, with legal professionals calling for a review of all judgments delivered by Justice Varma and pressing for an investigation by central agencies like the CBI and ED. A delegation of lawyers has traveled to Delhi to urge the central government to block the transfer, warning that such decisions could set a dangerous precedent for judicial oversight.
Amid the growing unrest, Rajya Sabha Chairman Jagdeep Dhankhar has stepped in, convening a meeting with floor leaders of various political parties to discuss the implications of the case. The meeting follows demands from several MPs for a parliamentary discussion on the judicial crisis, with concerns raised over the integrity of the system and the need for greater transparency in judicial appointments. Dhankhar pointed to the now-scrapped National Judicial Appointments Commission (NJAC), arguing that had it been in place, the situation could have been handled differently.
The Supreme Court, meanwhile, has defended its decision, stating that Justice Varma’s transfer was part of routine judicial administration and not linked to the cash recovery. However, all judicial duties have been withdrawn from him pending further inquiry. Despite this clarification, the controversy has deepened, with opposition leaders and legal experts questioning whether the transfer is a way to deflect attention from the scandal rather than address it head-on.
As tensions rise, the judicial crisis is turning into a larger debate on transparency, accountability, and the effectiveness of the collegium system. With the Supreme Court’s inquiry panel expected to submit its findings soon, the case of Justice Yashwant Varma is emerging as a defining moment in India’s legal and political landscape.
