Tax refund delayed? Delhi High Court says you deserve interest too

New Delhi: In a major relief for taxpayers, the Delhi High Court has directed the Income Tax Department to pay a man ₹3.55 lakh as interest on his ₹6.42 lakh tax refund, which had been pending for years.
The total amount — nearly 53% of the refund value — must be paid within eight weeks, the court said.
What Happened
Mr. Goel had been waiting for his tax refunds for assessment years 2007–08, 2015–16, 2017–18, and 2018–19. Even though the Commissioner of Income Tax (Appeals) had ruled in his favour back in 2017, the refund was still not issued.
Frustrated by the long delay, Mr. Goel approached the Delhi High Court under Articles 226 and 227 of the Constitution, seeking justice.
Advocates Himanshi Goel and Mayank Sharma represented him.
What the Delhi High Court Said
- In its judgment dated September 17, 2025, the High Court made it clear that:
- The Income Tax Department must release the full refund, along with applicable interest, within eight weeks.
- The breakup of the payment (how much refund and how much interest) should also be shared with the taxpayer.
- If Mr. Goel believes the amount paid is less than what he deserves, he can make a written representation to the Assessing Officer (AO), who must respond within four weeks.
- If still unsatisfied, Mr. Goel can revive his petition in court.
Why This Matters to You?
This judgment shows that taxpayers have the right to claim interest if their income tax refund is delayed — even if the refund relates to older assessment years.
The ruling reminds everyone that the Income Tax Department is legally bound to pay not just your refund, but also interest for the delay, as per the Income Tax Act.
What You Can Do if Your Tax Refund is Delayed?
- Check refund status on the Income Tax e-filing portal
- Write to your Assessing Officer if the refund is pending for months.
- If no action is taken, approach the Commissioner (Appeals) or even file a writ petition in the High Court — just like Mr. Goel did.
- You can claim interest under Section 244A of the Income Tax Act for the delay.
