The Kerala High Court on Wednesday questioned the drama surrounding Boby Chemmanur’s bail, telling his lawyers there was no need for such theatrics after the bail was granted. The court questioned Boby’s decision to remain in jail for other prisoners, stating that such matters should be handled through proper channels and courts, and not by Boby.
The court also reminded Boby that he should not believe there is no authority above him and summoned his lawyers to clarify his actions. Justice P V Kunhikrishnan stated that the court is capable of cancelling Boby’s bail if necessary. He also warned that the court has the authority to keep him in jail and proceed with the trial without his release.
Earlier, speaking to the media upon his release, Boby had explained, “I stayed behind to help fellow prisoners – around 26 people – who had no money or means to get out even after being granted bail, as they couldn't pay the Rs 5,000 or Rs 10,000 required for their release. I stayed for one more day to hear their concerns, that's all. It is not contempt of court.” He also said that the bail order could not be delivered on Tuesday because of a traffic jam, which was the reason for his decision to remain in jail.
Court questions delay in Boby Chemmanur's release
However, the release order was granted by the magistrate at 4:45 pm on Tuesday, and Boby could have been released from jail before 7:00 pm. The court questioned why this didn’t happen. Given the traffic, the distance from the Ernakulam Magistrate Court to Kakkanad Jail could be covered in about an hour. The court also stated there was no need for any attempt to attract media attention.
Despite being granted bail by the Kerala High Court on Tuesday, Boby chose to stay in jail. He had earlier informed his legal team of his plan to remain behind bars as a protest, showing support for prisoners who, despite being granted bail, are unable to secure release due to procedural issues.
