Maliwal assault case: Delhi HC denies bail to Bibhav Kumar

New Delhi: The Delhi High Court on Friday denied bail to Chief Minister Arvind Kejriwal's aide Bibhav Kumar who is accused of assaulting AAP Rajya Sabha member Swati Maliwal.

Justice Anoop Kumar Mendiratta dismissed Kumar's bail plea, saying no ground to grant him the relief was made out.

"This is a legal fight and we totally trust the courts, but it is saddening that in cases where anticipatory bail is generally granted... we will study the detailed High Court and take legal remedy as deemed necessary,"Sanjeev Nasiar, AAP legal cell head and lawyer.

Kumar, presently in judicial custody, allegedly assaulted Maliwal on May 13 at Kejriwal's official residence. He was arrested on May 18.

An FIR was registered against Kumar on May 16 under various provisions of the Indian Penal Code, including those related to criminal intimidation, assault or criminal force on a woman with the intent to disrobe, and attempt to commit culpable homicide.

The Delhi Police filed an FIR based on the complaint of Maliwal on Thursday. In her complaint, Maliwal alleged that Kejriwal's aide, Bibhav Kumar, "slapped" her "at least seven to eight times" while she "continued screaming" and "brutally dragged" her while "kicking" her in her "chest, stomach, and pelvis area."

Kumar had sought bail, claiming the allegations were false and his custody was no longer required as the probe was over. PTI
