Facing a shortage of drivers and conductors, the Metropolitan Transport Corporation sought to address the issue by launching a special recruitment drive through outsourcing. However, the Employees Federation vehemently opposed this initiative, contending that it contravened a prior agreement with the management. The agreement stipulated that all appointments would be directly handled by the management.
The Court, in response to the petition, expressed disapproval of such an undertaking, deeming it undesirable and untenable based on the petitioner's objections. The Court found merit in the petitioner's arguments, highlighting the flaws in the management's rationale.
The Court annulled the management's notification regarding the recruitment process.
