Woman entitled for motor accident compensation after remarriage: HC
Kochi: The Kerala High Court pronounced that a widow is entitled to get motor accident compensation of her husband even after her remarriage. The court issued the crucial judgment while considering the petition on denial of motor accident claim by an insurance company.
Wife of late Muvattupuzha native Anil Abraham and her parents were the petitioners in the case. Anil Abraham died in a road accident in 2002. In the petition, they complained that the motor accident claim tribunal sanctioned very low amount as compensation for Anil’s death.
Anil died after his bike collided with a car on the Ernakulam-Palarivattom road. He died within 3 months of his marriage.
As his widow married again in 2005, the insurance company rejected her insurance claim arguing she is no more entitled to it. Now, justice N Nagaresh issued an order rejecting the insurance company’s argument.
“In the present situation, people don't think a woman should continue as widow for the rest of her life after her husband’s death. Only outdated people think that woman will detach from the deceased husband’s family after remarriage,” noted the judge.
The court pointed out that the woman did not divorce her husband.
The tribunal had directed to provide Rs 7,64,500 to Anil’s widow. Observing the amount to be too low, the High Court ordered to give Rs 23.2 lakh as compensation and interest within a month.
