Kochi: The high court quashed the verdict of the trial court in the sensational Walayar case. The trial court had acquitted all accused in the case earlier. The high court approved the appeal filed by the victims’ mother and the state government and quashed the verdict of the POCSO court in Palakkad.
The high court also ordered for a retrial. The case has been handed over to the trial court for reinvestigation. The accused are directed to appear before the trial court on January 20. The prosecution can cross-examine more witnesses as part of the retrial.
The court also pointed out the lapses from the part of the investigative officers, prosecution and the trial court in the case. The high court also instructed to give special training to the POCSO court judges.
Following the high court verdict, a reinvestigation also can be conducted into the case. The case can be reinvestigated after seeking permission from the trial court. This will help the police to correct the mistakes in the current charge sheet and find out stronger evidences to prove the crime.
