Vaccine challenge: Forced contribution not allowed; HC directs to refund amount within 2 weeks
Kochi: The Kerala high court directed that the people should not be forced to make contribution to the Chief Minister’s Distress Relief Fund (CMDRF) as part of vaccine challenge. The court also pointed out that fund can be collected to the CMDRF only if they have legal permission for the same.
Two persons retired from Kerala State Electricity Board (KSEB) approached the court pointing out that one day’s salary was cut from their pension amount as part of vaccine challenge. They demanded a refund as they had not given any written permission for the same. Considering the petition, Justice Devan Ramachandran ordered to refund this amount.
It has been directed to refund the cut amount within two weeks. Also the authorities should assure that they would not cut the amount from pension without permission in future. The KSEB’s move to cut the amount without permission is legally invalid, the court pointed out.
The KSEB argued that they cut the amount from the pension on the basis of the permission granted by the KSEB Pensioners Association and that the court should not order to refund the same. However, the court did not consider the argument.
