Shuhaib murder: HC Division Bench stays CBI probe
Kochi: The Kerala High Court Division Bench stayed the order for a CBI probe into the Shuhaib murder. The Division Bench order came on the appeal filed by the government. Earlier, Justice Kemal Pasha had ordered for CBI probe into the case on the petition filed by Shuhaib’s family. The court stayed this order.
The High Court Division Bench has no authority to consider the plea filed by the government. The counsel of Shuhaib’s father argued in the court that the Kerala High Court has no appellate jurisdiction over the cases from Mattannur in Kannur, which was part of the then Madras Presidency, and so the case should be considered by the Supreme Court.
In this context, the Division Bench informed that a detailed examination is required on the grounds of this alleged legal issue. Hence, the Division Bench stayed the order for CBI probe into the case. The stay is valid till March 23, when the court will consider the appeal of the government again.
