Sexual harassment complaint filed when a long-term relationship is broken will not stand: Kerala HC

Kochi: Kerala High Court on Friday observed that women cannot accuse sexual harassment when the affinity is broken after being in the relationship for a long period of time.

Physical relationships purely based on the offer of marriage amounts to rape when the promise is broken. But a partner cannot accuse rape after the relationships has run its course, the court said.

The observation was made while considering the bail plea of an advocate who was accused of sexual harassment by his girlfriend.

The woman was told that the advocate will never marry. But when he agreed to a proposal, the girlfriend tried to kill herself in front of him. Following this, she filed the complaint. It cannot be accepted, the court said while allowing the plea of the accused.
