Kochi: Former High Court judge Justice Kemal Pasha said the apex court must hear the woes of the residents who are staying in the Maradu flats considering the principles of natural justice. He said it is not the building that is getting demolished but the lives of people who are staying there. He said this when he visited the Maradu flat owners here today.
The SC had pronounced the order by not hearing those who were affected by the directive. As per Section 142, the Supreme Court has the right to assure complete justice. Abiding by this, an order covering the protection of the owners of the flat too would have been welcome. By way of curative petition, we can hope that this would be fulfilled, Kemal pasha said.
The state government had only delayed in implementing the SC verdict and is unable to do anything. If the flats are demolished, the government is bound to provide an alternative arrangement. The government must consider on how the SC order can be overcome and further action initiated.
