Sabarimala airport: HC quashes key clause regarding land acquisition

Kochi: The Kerala High Court on Friday, cancelled a key clause in the order issued by state government regarding the takeover of Cheruvally Estate for the proposed Sabarimala Greenfield airport. HC quashed the clause that stated land can be acquired by depositing money at the court as the case regarding ownership of the concerned land is pending at the court.

The government had issued the order in June, at a time when there is a disagreement over the ownership of land between Believers Church and government. Following this, Ayana Charitable Trust under Believers Church approached the High Court. In the petition they had stated that through various cases they have proved their right over the land and the money to acquire this land should be given to them and not deposited at the court.

Considering the petition, HC cancelled the clause.

However, the court didn’t intervene in any other clause in the order issued by Revenue Secretary handing over the land acquisition procedures to the Collector. Hence, government will be able to acquire the land through other means. But more clarity on the matter is required to proceed with it, pointed out legal experts.
