Rape case: Binoy Kodiyeri moves HC to quash FIR
Mumbai: Binoy Kodiyeri, who has been accused of rape by a Bihar native woman, moved the Bombay High Court demanding to quash the FIR filed against him at the Oshiwara police station. The plea will be considered by Bombay HC on July 24.
The new move comes just before he is to appear before the investigation officer on Monday.
Binoy had approached Bombay HC last Wednesday demanding to quash FIR. Earlier while granting anticipatory bail to Binoy, the sessions court had pointed out the contradictions in the complainant woman’s statements and the time lapse between the incident and filing of complaint. In this backdrop, Binoy approached the court to quash the FIR.
The main argument of Binoy is that the case was forged. He also pointed out the contradictions in the woman’s statement. The sessions court had asked Binoy to appear for DNA test. It is learnt that the plea has been filed now, to avoid the DNA test.
While granting anticipatory bail, the court had asked him to appear before the investigation officials every Monday. As per the condition, he has to appear today. Last week, when he appeared, he had cited health ailments and refused to provide blood samples for DNA test.
