Progressive govt can't deny EWS reservation to non-religious people

Kochi: Kerala High Court on Friday said that a progressive government cannot deny benefits of reservation of the economically weaker sections to non-religious people.

Justice VG Arun directed the state government to do the necessary to issue community certificates for non-religious people. The interim-order was issued in the plea of five students who declared non-religious in the school certificate and who moved the court against denial of reservation for Economically Weaker Sections in the forward communities.

The Kerala State Commission for Economically Backward Classes among Forward Communities (KSCEBCFC) has published the list of 164 communities eligible for reservation. It does not include non-religious people. The petitioners contended that it was violation of the constitutional principles.

The court opined that the petitioners uphold the ideology of secularism which is enshrined in the constitution. In the order, Justice Arun asked the government to issue the petitioners 'non-religious certificate' to avail the reservation and prepare a policy to avoid a similar situation in the future.
