Kochi: Kerala government on Tuesday approached the Supreme Court against the Kerala High Court’s judgement providing anticipatory bail to actor-producer Vijay Babu, booked in actress assault case.

Over the matter, state government’s counsels and Supreme Court Standing Council on the other day had a deliberation.

The state government is likely to furnish the arguments over Babu’s fleeing and demand custody of him for quizzing.

The accused fled the country after the FIR was registered. He approached for anticipatory bail while on the run. In that scenario, his plea should not have been considered by the HC. These are the possible arguments in state government’s platter.

While state government may point out the 'illegality' of issuing protection from arrest over the anticipatory bail plea that should not have been considered. The court’s decision on the other day to not to entertain the anticipatory bail plea of an accused in another case who fled to Kuwait will be cited by the prosecution, say sources.
