HC terms strike of employees illegal, calls for strict action

Kochi: Kerala High Court here on Thursday recommended strict action against the strike of government employees. The court observed that employees who observe strike are not entitled to salary.

The criticism from the court came while hearing a petition requesting the court to restrict employees from attending a 48-hour strike announced by trade unions.The strike observed by government employees is illegal. Therefore, distributing salary to such employees looks like the government is equal to supporting the protest, the court viewed.

The court pointed out that as per rule 86 of the service act, the strike is illegal.

Government employees observed strike against union government policies on January 8 and 9 in 2019. Initially, the LDF government refused to announce Dies non. However, the High Court directed the state government to issue Dies non.

Following these events, a lot of Public Interest Litigations were filed in the high court.
