Fake complaint as cruel as rape: Kerala HC on MLA Eldhose Kunnapillil's case

Kochi: The Kerala high court on Monday asked whether the physical interaction between the complainant and the accused MLA, Eldhose Kunnappilly, was consensual. The court orally observed that the complaint sounds like a film story.

HC said, while going through the complaint, the duo seemed to have had consensual relationship.

The comments were made while the court was considering the plea of the complainant to cancel the anticipatory bail given to Eldhose. The complainant was also present in court.

The court asked if the original complaint contained allegations of sexual assault. The prosecution replied that it did not.

The court further said a fake complaint is as cruel as rape. It also asked how charges of attempted murder could be brought in the case.

The prosecution said that the MLA was not cooperating with the investigation. The HC will next hear the defence before deciding on the plea.
