Kochi: A local court here rejected the petition filed by solar scam case accused Saritha S Nair requesting a copy of the confidential statement given by Swapna Suresh, the prime accused in the gold smuggling case. While snubbing the demand, the Ernakulam Principal Sessions Court pointed out that only the investigating agency is entitled to have a copy of the statement submitted under CrPC section 164.
The court also viewed that others can have a copy once the investigation is completed. Earlier, the court had rejected a similar petition from the Crime Branch.
In the petition, Saritha pointed out that her name was mentioned in Swapna's statement, and therefore she was entitled to get a copy of it. Saritha said she would approach the High Court against the Sessions' court verdict.
Earlier, the court said that the Crime Branch was not the investigating agency in the case. Therefore, they were not entitled to get a copy of the confidential statement.
