Kochi: Ernakulam Principal Sessions Court rejected the petition filed by Saritha S Nair seeking a copy of the confidential statement recorded by Swapna Suresh under Section 164 of the CrPC. The court also stated that the copy cannot be handed over to anyone until the investigation is completed. The court also mentioned about the dismissal of the plea submitted by the Crime Branch over the same matter.
Saritha has stated in her plea that her name has been mentioned in the statement given by Swapna and that she has the right to get a copy. However, Saritha’a petition was rejected stating the same reasons listed by the court while rejecting Crime Branch’s petition. Saritha informed that she will move High Court against the lower court’s verdict.
The court also clarified that the copy of the statement has been handed over to the investigating agencies and that the Crime Branch cannot be considered as an investigating agency in this case. The court also questioned what right the Crime Branch has to request a copy of Swapna’s statements. The Crime Branch informed the court that there is an underlying conspiracy behind Swapna’s confidential statement and that a case has been registered against her at Cantonment Police Station. It was also pointed out in the court that the statements are needed for the investigation of the case.
