Actress attack case: SC rejects Dileep’s plea to stay trial
New Delhi: The plea filed by actor Dileep in the Supreme Court in connection with the actress attack case has been rejected. Dileep had demanded to stay the trial process in the case as the visuals of the attack was under examination at the Central Forensic Science Laboratory in Chandigarh. Dileep had requested to stay the procedures and restart the trial once the report from CFSL is obtained.
Meanwhile SC deferred the petition, filed by Dileep against the High Court order that rejected his discharge petition, to be considered after the report from CFSL.
Dileep’s counsel and senior advocate Mukul Rohatgi had said in the court that proceeding with trial procedures before the results of forensic examination is like denying legal rights. It would be the violation of SC order.
However, the bench including justices A M Khanwilkar and Dinesh Maheswari observed that the trial can’t be delayed longer. There are more than 130 witnesses in the case. They can be called to testify. However, Dileep will be crossed only after obtaining the report from CFSL. There is no stay on the trial process, SC said instructing CFSL is file the report at the earliest.
Rohatgi said in the court that the trial court and HC rejected the discharge petition without even considering the point of CFSL report. Following this the apex court slated it to be heard after obtaining the report.
SC had earlier permitted Dileep to examine the visuals of the attack with independent agencies including Central Forensic Science Laboratory. Court also had said that witnesses could be presented at the court based on this report. However, this report can’t be handed over to anyone who is not connected with the case before the completion of the trial.
