Kochi: Kerala High Court Judge Kauser Edappagath recused himself on Friday from hearing a petition filed by the survivor in the 2017 actress assault case against shifting trial from Special CBI Court to Principal District Sessions Court.
Earlier, the Special CBI Court had decided to take up hearing of the case as per the HC direction. However, in a peculiar move the trial was shifted to Principal District Sessions Court. The High Court Registry through an office order was shifting the case. The survivor submitted a petition against this and claimed that the move was illegal.
The HC will likely take up the matter on Monday. The petition will be adjudicated by another bench embodied by the Chief Justice.
Meanwhile, Judge Kauser Edappagath earlier had recused from hearing the petition filed by the survivor to re-examine the memory card. The survivor had expressed her dissatisfaction in the case hearing. The footage of the actress getting attacked was leaked when the case was heard by the district court. The survivor indicated that Justice Kauser Edappagath is under the shadow of doubt and requested his replacement.
Recently Supreme Court Judges MR Shah and Justice DY Chandrachud had rapped Supreme Court Registry for modifying case list without prior intimation.
