Binoy Kodiyeri seeks to defer trial in rape case


The complainant's lawyer is expected to produce a response on January 15. The final judgment on the application is expected after this.

Mumbai: Binoy Kodiyeri, son of CPM leader Kodiyeri Balakrishnan, has approached the court seeking to postpone the trial in the rape case charged against him. Following this, the court has sent a notice seeking a response from the complainant woman.

In the application filed at the Dindoshi Sessions Court, Binoy requested to postpone the trial as he was abroad. “As the trial procedures are slated to begin on January 21, it would be difficult for me to reach the court and so the trial should be postponed by 15 to 20 days,” he added.

The application was considered in the court on Tuesday and a notice was sent to the complainant. The complainant's lawyer is expected to produce a response on January 15. The final judgment on the application is expected after this.

According to the complaint, the woman, who hails from Bihar, entered into a relationship with Binoy Kodiyeri while working at a dance bar in Dubai in 2008 and till 2015, he used to send her money every month. They also have an eight-year-old child.

The Mumbai-based woman filed the FIR last year after coming to know that Binoy was already married. After being on the run for some time, Binoy last year got bail from the Dindoshi court in Mumbai on the condition that he should undergo a DNA test and cooperate with the police investigation.

In July last year, he underwent the DNA test and the test results were submitted to the Bombay High court, a few weeks ago. The Mumbai police had filed a 440-page charge sheet against Binoy at the Andheri Metropolitan Magistrate Court.
